Childcare Services Agreement between Sultan School District No. 311 and The Boys & Girls Clubs of Snohomish County This agreement for childcare service is entered into on (the “Effective Date”) between Sultan School District No.311 (‘District’) and The Boys & Girls Clubs of Snohomish County (“Provider”) (collectively the “Parties”). The school site for the 2024 — 2025 school year will be at Gold Bar Elementary School. The Boys & Girls Clubs of Snohomish County will: 1. Provide quality care for school-age children (grades k-5) called “Boys & Girls Club Sultan Unit, Gold Bar Site” beginning February 3, 2025. a. Enrollment will be based on licensing standards for the allocated space (35 square feet per child). Financial assistance is available to low income families. A minimum enrollment of 15 FTE children is necessary for the program to operate long term. b. Priority enrollment in the program will be to students attending the designated school and living in that school’s service area. c. Program activities for the childcare will be the responsibility of the Provider, not an extension of school programs. d. Before and after school childcare will be offered. Hours of operation will be 6:00 am — until school begins and after school until 6:00 pm, Monday through Friday. Childcare will be provided for early dismissals and late starts. e. Childcare will not be offered at the school site on days school is canceled or closed. Program attendees will be offered the ability to attend the main club in Sultan on these days unless the Provider is also closed on those days. The Provider will communicate these closures with program attendees and the District in advance. f. A qualified site leader (defined by the Provider and over 21 years of age), will always be on site (with the possible exception of first and last hour and/or absences). A competent assistant leader (18 or older) will replace the site leader when they are off site. 2. For liability purposes, provide a statement of compliance for the management of concussion and head injury in youth activities as required by RCW28A.600; a statement of compliance with the policies for sudden cardiac arrest awareness as set forth in RCW28A.600.195; and provide proof of insurance as stated below and required by RCW 4.24.660. a. Insurance Requirements: Provider shall obtain and maintain the following insurance for the duration of the agreement i. Commercial General Liability of one million dollars ($1,000,000) for any one occurrence and one million dollars ($1,000,000) aggregate. b. The Provider, at its sole cost and expense, will secure and maintain at least the insurance types and limits identified above on an occurrence basis, to protect the District, its successors, assigns, and the respective directors, employees, and agents of 10. 11. 12. the foregoing from and against any and all claims, losses harm, costs, liabilities, damages, and expenses arising out of or in connection to the agreement. The District shall be named as an additional insured on the Providers Commercial General Liability and the Provider shall provide the District with a Certificate of Insurance with Additional Insure Endorsement naming the District as an additional insured. Be responsible for all staffing and employer related responsibilities including background checks on all employees and volunteers. The Provider agrees to protect, indemnify and hold harmless the district, its elected and appointed officials, employees, agents, staff, and volunteers from any and all claim, liabilities, damages, expenses, or rights of action, directly or indirectly attributed to the Provider's activities and/or use of the premises. Complete a Sultan School District Facility Use agreement for each space used. Be responsible for daily clean-up of the spaces occupied. Provide bins, cabinets, and other mobile temporary storage means for all program supplies and equipment. The Provider employees, directed by the site leader, will open and close the facility as directed by the District. Pay for any damages to the facility and equipment that are directly caused by program participants. Any damage will be reported immediately to the principal or their designee. Provide a cellular telephone which will be wireless and stored when the program is not in operation. Provide contact information for the sole use of the District to reach the Provider in an emergency situation outside of defined operational hours. Follow all district and building policies, including all district safety and security protocols.” Sultan School District No.311 will: 1. Provide consistent space at available site for use by the Boys & Girls Club program, beginning February 3, 2025. Space available for use to the Provider is outlined in appendix A as provided by the school principal. Access to the gym, library, and playground will be permitted based on this schedule. Access to restrooms will be available. Provide sanitary and appropriate hand washing areas. (Custodial sinks will not be used). Provide space for the Provider to store program supplies and equipment within the building. Provide necessary permanent equipment (i.e. fire extinguisher, fire alarm system, etc., as deemed necessary by the state fire marshal). Provide tables and chairs (or similar equipment such as cafeteria tables) for the provider to use during the program. Clean and sanitize restrooms daily. Assure the school principal or their designee will serve as a liaison to the site leader/unit director of the Boys & Girls Club for open communication. This agreement will stay in effect from the effective date to the end of the 2024-2025 school year, at which time it shall be reviewed and renewed to the satisfaction of both parties. This agreement can be canceled upon a 60-day notice by either party if the program is not satisfactory and after reasonable attempts have been made to resolve the problem(s). This working agreement has been reviewed and approved for the year February 3, 2025. through June 30, 2025.
